All content, deduction suggestions, and calculations provided by this Service are for informational and organizational purposes only and do not constitute professional tax advice. 1. Acceptance of Terms
These Terms of Service ("Terms") govern your access to and use of MyTaxWriteOffs, operated by Level Up Health Solutions LLC ("Company," "we," "us," or "our"). By creating an account or using the Service, you agree to be bound by these Terms and our Privacy Policy. If you do not agree, do not use the Service.
2. Description of Service
MyTaxWriteOffs is a software tool that connects to your financial accounts via Plaid, analyzes your transaction history, and uses AI to suggest transactions that may qualify as tax deductions based on your profession. The Service is designed to help you organize your financial records — it is not a substitute for professional tax or accounting advice.
3. Not Tax or Legal Advice
The deduction suggestions, categorizations, tax estimates, and any other financial information provided by the Service are for informational and organizational purposes only. This information:
- Does not constitute professional tax advice, legal advice, or accounting services
- May not reflect the most current IRS rules or tax law changes
- May not be accurate or applicable to your specific tax situation
- Should not be used as the sole basis for any tax filing or financial decision
You are solely responsible for verifying deductions with a qualified tax professional and for the accuracy of your tax filings. The Company is not responsible for any taxes, penalties, interest, or other liabilities arising from your use of the Service.
4. Third-Party Financial Data (Plaid)
The Service uses Plaid Inc. ("Plaid") to facilitate connections to your financial institutions. By connecting accounts, you agree to Plaid's Terms of Use and End User Privacy Policy. You grant Plaid the right to retrieve your financial data on your behalf. We do not receive or store your banking credentials.
We are not responsible for Plaid's actions, errors, data inaccuracies, or service availability. Transaction data retrieved via Plaid may not be complete or entirely accurate and should not be relied upon for final tax filings without independent verification.
5. Eligibility
You must be at least 18 years old and a resident of the United States to use the Service. By using the Service you represent that these requirements are met.
6. Account Responsibilities
You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account. Notify us immediately at support@mytaxwriteoffs.com if you believe your account has been compromised.
7. Subscriptions and Billing
The Service offers a free tier and a paid Pro plan billed monthly or annually. All billing is processed through Stripe, Inc. and fees are stated in USD.
- Billing cycle: Subscription fees are charged at the start of each billing period (monthly or annually) and auto-renew until cancelled.
- Cancellation: You may cancel at any time through your account settings or by emailing support@mytaxwriteoffs.com. Pro access continues through the end of the paid period. No cancellation fees apply.
- Price changes: We will notify active subscribers by email at least 30 days before any price increase. Your continued use after the effective date constitutes acceptance.
- Refunds: See our Refund & Cancellation Policy for full details. In general, fees are non-refundable except for billing errors, extended outages, or where required by law.
8. Acceptable Use
You agree not to:
- Use the Service for any unlawful purpose or in violation of these Terms
- Attempt to reverse-engineer, scrape, or exploit the Service
- Share your account credentials with others
- Submit false or misleading information
- Use the Service to evade taxes or engage in tax fraud
9. Intellectual Property
The Service and its original content, features, and functionality are owned by Level Up Health Solutions LLC and are protected by copyright, trademark, and other intellectual property laws. You may not reproduce, distribute, or create derivative works without our written consent.
Your data (transactions, notes, and other information you provide) remains yours. You grant us a limited license to use it solely to provide and improve the Service.
10. Disclaimer of Warranties
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR THAT DEDUCTION SUGGESTIONS WILL BE ACCURATE OR COMPLETE. YOUR USE OF THE SERVICE IS AT YOUR SOLE RISK.
11. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, LEVEL UP HEALTH SOLUTIONS LLC AND ITS OFFICERS, DIRECTORS, EMPLOYEES, AND AGENTS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOST PROFITS, TAX PENALTIES, OR LOSS OF DATA, ARISING FROM YOUR USE OF THE SERVICE. OUR TOTAL LIABILITY TO YOU FOR ANY CLAIM SHALL NOT EXCEED THE AMOUNT YOU PAID US IN THE 12 MONTHS PRECEDING THE CLAIM.
12. Indemnification
You agree to defend, indemnify, and hold harmless Level Up Health Solutions LLC from any claims, damages, or expenses (including reasonable attorneys' fees) arising from your use of the Service, your violation of these Terms, or your violation of any third-party rights.
13. Termination
We may suspend or terminate your account at any time for violation of these Terms. You may terminate your account at any time by contacting us. Upon termination, your right to use the Service ceases and we will handle your data per our Privacy Policy.
14. Governing Law
These Terms are governed by the laws of the State of Florida, without regard to its conflict-of-law provisions. Any disputes shall be resolved in the state or federal courts located in Pinellas County, Florida.
15. Changes to Terms
We reserve the right to modify these Terms at any time. We will notify you of material changes by email or prominent notice on the Service. Your continued use after changes are posted constitutes acceptance of the updated Terms.
